AALIYAH'S PLAY LAND

WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT

ACKNOWLEDGMENT OF INHERENT RISKS (TEXAS DISCLOSURE)

I understand that activities at Aaliyah's Play Land, LLC include, but are not limited to, bounce houses, inflatable attractions, climbing structures, slides, obstacle courses, and related indoor and outdoor recreational activities (collectively, the "Activities").

I understand that participation in the Activities involves inherent and significant risks, including but not limited to falling, slipping, tripping, collisions with persons or objects, entanglement, equipment malfunction, surface hazards, weather-related risks, and physical exertion, which may result in serious bodily injury, permanent disability, paralysis, or death.

I knowingly and voluntarily choose to participate, or allow my child or ward to participate, in the Activities with full knowledge and understanding of these risks.

ASSUMPTION OF RISK

I freely and voluntarily assume all risks, both known and unknown, foreseeable and unforeseeable, associated with participation in the Activities and presence on the premises of Aaliyah's Play Land, LLC, even if arising from the negligence of the Released Parties, to the fullest extent permitted under Texas law.

RELEASE AND WAIVER OF LIABILITY (INCLUDING NEGLIGENCE)

In consideration for being permitted to enter the premises of Aaliyah's Play Land, LLC and participate in the Activities, I, on behalf of myself and or my minor child or ward, my heirs, assigns, and personal representatives, hereby release, waive, and forever discharge Aaliyah's Play Land, LLC, its owners, members, managers, officers, employees, agents, volunteers, contractors, affiliates, successors, and assigns (collectively, the "Released Parties") from any and all claims, demands, causes of action, damages, or liabilities of any kind, including those arising from the negligence of the Released Parties, resulting from or related to participation in the Activities or presence on the premises.

This release includes, without limitation, claims for personal injury, wrongful death, property damage, and any other loss, whether occurring on or off the premises.

INDEMNIFICATION AND HOLD HARMLESS

I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, actions, damages, costs, or expenses, including attorney’s fees, arising from or related to my participation or the participation of my child or ward, including claims brought by third parties, and including those caused by the negligence of the Released Parties, to the fullest extent permitted by Texas law.

MEDICAL AUTHORIZATION

I authorize Aaliyah's Play Land, LLC and its representatives to obtain emergency medical treatment for me or my child or ward if deemed necessary. I understand that the Released Parties assume no responsibility for any injury or damage arising from such medical treatment and that I am solely responsible for all related medical costs.

RULES, SUPERVISION, AND CONDUCT

I agree to comply with all posted rules, verbal instructions, safety guidelines, and staff directions. I understand that failure to follow rules may result in immediate removal from the premises without refund.

I understand that Aaliyah's Play Land, LLC does not provide constant one-on-one supervision and that I am solely responsible for supervising my child or ward at all times.

TERM AND TERMINATION

This Agreement is effective upon execution and shall remain in force indefinitely.

Either party may terminate this Agreement at any time, with termination effective immediately upon written notice. No notice period is required. Termination shall not affect any rights, duties, releases, waivers, assumptions of risk, or indemnification obligations accrued prior to the effective date of termination.

GOVERNING LAW AND VENUE

This Agreement shall be governed by and construed in accordance with the laws of the State of Texas. Venue for any legal action shall lie exclusively in the county in which Aaliyah's Play Land, LLC is located.

ACKNOWLEDGMENT AND SIGNATURE

I HAVE READ THIS AGREEMENT CAREFULLY AND FULLY UNDERSTAND ITS CONTENTS. I UNDERSTAND THAT BY SIGNING THIS DOCUMENT, I AM WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE FOR NEGLIGENCE.

PARTICIPANT, PARENT OR LEGAL GUARDIAN (REQUIRED IF PARTICIPANT IS A MINOR)

I am the parent or legal guardian of the minor named above. I consent to the minor’s participation and agree to all terms of this Agreement individually and on behalf of the minor.
